pqCode Ltd (“pqCode”, “we”, “us” or “our”) is committed to protecting the privacy of all visitors who access our websites or mobile applications (collectively, our “Service”). Please read the following privacy policy which explains how we use and protect your information. We’ll be the “data controller” of the information you provide to us. By visiting and/or using our Service, you agree to our Privacy Policy.




1.1 You may give us information about you, such as when you create or modify your account, scan your pqCode, contact customer support, or otherwise communicate with us. This information may include your name, contact details and payment information such as credit or debit card information. We may also collect information about your usage of our Service and information about you from the e-mails or letters you send to us.


1.2 We may also collect technical information about your use of our Service through a mobile device, for example, location data and certain characteristics of, and performance data about your device, carrier/operating system including device and connection type, IP address, mobile payment methods.




pqCode does not sell or share your personal information to third parties for third party direct marketing purposes. We use the information we collect to provide, personalise, maintain and improve our Service. This includes using the information to:


2.1 Provide, maintain, and improve our Service, including, for example, to supply the services you have requested, facilitate payments, send receipts, develop new features, provide customer support, authenticate users, and send product updates and administrative messages;


2.2 Perform internal operations, including, for example, to prevent fraud and abuse of our Service; to troubleshoot software bugs and operational problems; to conduct data analysis, testing, and research; and to monitor and analyse usage and activity trends;


2.3 Send or facilitate communications between you and the Participating Retailers (as defined in our Terms of Service);


2.4 Send you e-mail communications about our products and services that may be of interest to you (where you have given your consent).




We will never disclose your personal information to any third parties except in these circumstances set out below:


3.1 Payment providers for the purposes of providing services to us, for example when they process information such as credit card payments for us or carry out fraud checks for us; IT service providers for the purposes of technical support; Participating Retailers that you have placed your order with so that they can resolve any issues.


3.2 If our business enters into a joint venture with, purchases or is sold to or merged with another business entity, your information may be disclosed or transferred to the target company, our new business partners or owners or their advisors.


3.3 We may share your information if we are under a duty to disclose or share your information in order to comply with (and/or where we believe we are under a duty to comply with) any legal obligation; or in order to enforce our Terms of Service and any other agreement; or to protect the rights of pqCode, Participating Retailers or others. This includes exchanging information with other companies and other organisations for the purposes of fraud protection and prevention.




4.1 We take steps to protect your information from unauthorised access and against unlawful processing, accidental loss, destruction and damage.


4.2 Unfortunately, the transmission of information via the internet is not completely secure. Although we will take steps to protect your information, we cannot guarantee the security of your data transmitted to our Service; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.




5.1 We will keep your personal information for no longer than necessary for the purposes collected, for its legitimate business interests, or for a period specifically required by applicable regulations or laws, such as retaining the information for regulatory reporting purposes.


5.2 We take steps to protect your information from unauthorised access and against unlawful processing, accidental loss, destruction and damage.

6.3 The right to rectification. If pqCode has information about you that you believe is inaccurate, you have the right to request correction of your information.


6.4 The right to erasure. You may request the deletion or removal of certain of the information that we hold about you. We may retain certain information about you as required by law and for legitimate business purposes permitted by law.


6.5 The right to data portability. You have the right to obtain your personal information in an accessible and transferrable format so that you can re-use it for your own purposes across different service providers. This is not a general right however and there are exceptions.


6.6 The right to lodge a complaint. You have the right to lodge a complaint about the way we handle or process your information with the national data protection authority.
